Dem Rep. Wonders If US Marshals Should Arrest Trump for Contempt of Court

In a recent House Judiciary Committee hearing, Democratic Representative Hank Johnson of Georgia posed a provocative question regarding the potential legal ramifications for President Donald Trump. The inquiry centered on whether U.S. Marshals could be tasked with jailing Trump for contempt in relation to the Department of Government Efficiency (DOGE).
During the hearing, Circuit Judge Timothy Tymkovich of the U.S. Court of Appeals for the 10th Circuit provided testimony. His primary focus was on the pressing issue of a shortage of federal judgeships.
However, the discussion took a turn when Rep. Johnson asked about the role of the U.S. Marshals Service in enforcing court orders.
“If a president willfully failed or refused to comply with a court ruling, they could be held in contempt of court theoretically,” Johnson stated. He further queried whether it would be the responsibility of the U.S. Marshals Service, under the Justice Department, to enforce such an order.
Judge Tymkovich responded, “Your hypothetical would have to play itself out,” emphasizing the speculative nature of the scenario.
The establishment of DOGE by President Trump, through a rebranding of the United States Digital Service, has been met with legal challenges. These challenges have been brought forth by government employee unions and Democratic state attorneys general.
Johnson expressed concern over the potential conflict of interest if the U.S. Marshals, under the Justice Department’s command, refused to execute a contempt order. “What would then be the state of our democracy?” he asked.
Tymkovich, however, redirected the conversation back to the judiciary’s needs, stating, “I’m here on behalf of the judicial conference to talk about the shortage of judges that we have.”
Rep. Johnson is no stranger to controversial statements, having previously questioned whether the deployment of additional military personnel to Guam could cause the island to capsize. Additionally, he has claimed that classified documents were planted in the residence of then-President Joe Biden.

Talk about a congressman who needs a serious mental evaluation. And also give a copy of the Constitution to find out that word democracy isn’t in it. Also not in the bill of rights, or the Declaration of Independence. He a good example of the need for term limits.

He asked a very logical question. First, the not-so-hypothetical situation: “If a president willfully failed or refused to comply with a court ruling? … Yesterday’s hearing in the federal district court in DC showed a sputtering attorney for the Administration unable to cite one instance of a funding grant that was unfrozen (disbursed), as ordered by the Court 10 days earlier.
Then the possible consequence: “they could be held in contempt of court theoretically,” Very true.
Then the logical question: who would enforce the contempt order? And how? The U.S. Marshals Service? But they’re part of the DOJ, normally independent but here subservient to defendant Trump. Very good questions indeed.
