Judges Delay Deportation of Salvadoran Migrant

In a series of rapid court decisions on Wednesday, federal judges in Tennessee and Maryland stopped ICE from immediately deporting Kilmar Abrego Garcia, offering him an opportunity for legal review before any potential removal.

Justice Department officials had previously indicated in court that transfer and deportation proceedings were imminent for Abrego Garcia, raising concerns about his access to counsel and fair process.

Department of Homeland Security Assistant Secretary Tricia McLaughlin responded on social media, stating, “Abrego Garcia will never walk America’s streets again.”

She further stated, “The fact this unhinged judge is trying to tell ICE they can’t arrest an MS-13 gang member, indicted by a grand jury for human trafficking, and subject to immigration arrest under federal law is LAWLESS AND INSANE.”

The rulings came as lawyers for Abrego Garcia expressed ongoing concerns about the administration’s compliance with due process protections and court orders.

Attorney Chris Newman emphasized the importance of adherence to legal procedures and protections for Abrego Garcia’s rights in this complex case.

In Nashville, U.S. District Judge Waverly Crenshaw ordered Abrego Garcia released from criminal custody pending trial, stating in his decision, “The federal government fails to provide any evidence that there is something in Abrego’s history, or his exhibited characteristics, that warrants detention.”

He addressed the government’s accusations regarding gang affiliation: “For the court to find that Abrego is member of or in affiliation with MS13, it would have to make so many inferences from the government’s proffered evidence in its favor that such conclusion would border on fanciful.”

Shortly after Judge Crenshaw’s order, U.S. Magistrate Judge Barbara Holmes granted a 30-day stay of Abrego Garcia’s release from criminal custody, as requested by his attorneys.

In Maryland, U.S. District Judge Paula Xinis issued an emergency order blocking ICE from taking Abrego Garcia into custody for immediate removal, and required advance notification to his counsel before any deportation action.

Simon Sandoval-Moshenberg, representing Abrego Garcia, commented, “These rulings are a powerful rebuke of the government’s lawless conduct and a critical safeguard for Kilmar’s due process rights.”

The legal battle remains ongoing, as critics allege that the administration is testing the limits of immigration law enforcement and compliance with federal courts.

The Supreme Court has previously ordered the administration to facilitate Abrego Garcia’s return to the U.S. from El Salvador, but future intervention is uncertain. Any further appeal could be heard by the U.S. Court of Appeals for the Sixth Circuit, which has a conservative majority.
