“There’s a harm there, and I think we can’t sweep that aside,” he said.

Justice Samuel Alito recognized concerns raised by female athletes regarding fairness in competition with biological males.

“What do you say about them. Are they bigots?” Alito asked. “Are they deluded in thinking they are subjected to unfair competition?”

The court’s decision, following three hours of arguments, is poised to impact laws in over two dozen states. Liberal justices, including Justice Sonia Sotomayor, voiced concern for the individuals affected by these bans.

“The numbers don’t talk about the human beings,” Justice Sonia Sotomayor said.
