“Your proposed order to show cause was reviewed by Judge Rivera, who declined to sign the order,” the court’s order stated.

This decision leaves no motion pending in the Court of Appeals, clearing the path for the sentencing to proceed.

The Supreme Court, however, has yet to make a decision on whether it will allow the sentencing to move forward. In a filing, it was argued that there is “a compelling public interest in proceeding to sentencing,” emphasizing the steps taken to minimize any inconvenience to Trump, including the option for him to attend virtually.

Merchan has indicated that he will not impose a jail sentence but will instead issue an unconditional discharge. This means Trump can appear virtually at the 10 a.m. hearing, avoiding the need for physical presence.

Earlier this year, a Manhattan jury found Trump guilty on 34 felony counts of falsifying business records. These charges are linked to a nondisclosure agreement with Stormy Daniels. Notably, the jury instructions did not require consensus on the specific crime Trump allegedly concealed through these falsifications.

Trump’s legal team has argued that the New York trial court “lacks authority to impose sentence and judgment” on him due to ongoing appeals concerning substantial claims of Presidential immunity. They have sought to have these issues resolved, potentially by the Supreme Court, before any sentencing occurs.
