WHAT YOU NEED TO KNOW:

  • FTX founder Sam Bankman-Fried has been released on a $250 million bail.
  • The hefty amount was not paid upfront, but hinged on his promise to stay confined to his parents’ Palo Alto home.
  • Bankman-Fried previously claimed that his bank account had about $100,000.

A New York federal court released FTX founder Sam Bankman-Fried on a $250 million bond after a hearing on serious criminal charges over his cryptocurrency exchange.

Last month, Bankman-Fried claimed that his bank account only had about $100,000.

The agreement required him to hand over his passport and remain confined and monitored at his parents’ Palo Alto home. Some exceptions included “medical, substance abuse, or mental health treatment,” as well as necessary events such as court appearances.

The bond agreement, set by Judge Gabriel Gorenstein, was referred to as the “largest-ever” pretrial bond by a federal prosecutor in the case.

Massive bail amounts such as this do not require an upfront payment, but can be secured in some other way of assurance that the defendant won’t violate its terms. The Palo Alto home of Bankman-Fried’s parents, along with others that weren’t identified in the filing, offered such a collateral.

The collateral value doesn’t necessarily have to be equal to the bail amount since it only serves as assurance of the defendant’s compliance.

“These amounts are often just numbers,” explained former federal prosecutor Andrey Spektor, now a white-collar partner at Bryan Cave Leighton Paisner LLP. “Sometimes defendants will sign bonds in the amount of hundreds of thousands of dollars when everyone knows they don’t have a penny to their name.”

Bankman-Fried’s ex-girlfriend Caroline Ellison, who was also former CEO of Alameda, and FTX co-founder Gary Wang pleaded guilty to their roles in the alleged fraudulent schemes. Both were released on a $250,000 bond on the condition that they stay within the “continental United States.”
