Court temporarily blocks Biden from lifting Title 42 border restrictions

- The court sided with Republican-led states that had filed a lawsuit to order the White House to temporarily retain the restrictions.
- The CDC announced on April 1 that it would end Title 42 on May 23.
A Louisiana federal judge on Monday granted a temporary restraining order preventing the Biden administration from lifting Title 42.
On April 1, the Centers for Disease Control and Prevention announced that it would end Title 42 on May 23. The CDC said the order “suspending the right to introduce migrants into the United States is no longer necessary” due to “an increased availability of tools to fight COVID-19.”
Title 42 is a pandemic-era public health order that allows the federal government to quickly expel migrants.
The original lawsuit was filed by Louisiana, Missouri, and Arizona in the U.S. District Court in Louisiana. Several other GOP-led states have since joined the lawsuit.
Last week, Fox News reported that Border Patrol is already not implementing Title 42 to expel some migrants coming from the Northern Triangle countries of Guatemala, Honduras and El Salvador. Border Patrol processed these migrants using Title 8 and expedited removal.
“We applaud the Court for approving our request for a Temporary Restraining Order to keep Title 42 in place,” Arizona Attorney General Mark Brnovich said Monday. “The Biden administration cannot continue in flagrant disregard for existing laws and required administrative procedures.”
Republicans and Democrats alike criticized the Biden administration after announcing that it would end Title 42. The US faces a historic surge in migrant encounters at the southern border, topping 221,000 in March.
Last week, the bipartisan Problem Solvers Caucus supported a bill that would prevent the Biden administration from ending Title 42 until 60 days after the CDC has officially lifted the COVID-19 public health emergency declaration.
Several Democratic Senators are supporting the bill in the upper chamber.
“I warned the administration about this months and months ago, and they still don’t have an adequate plan,” Sen. Mark Kelly, D-Ariz., told Fox News Digital. “They say they are working on it. My guess is that we’ll get to May 23, there probably is not going to be an adequate plan in place and, if that’s the case, I don’t think we should lift Title 42.”

There are other, much older, laws on the books regarding how we handle illegal immigrants and asylum seekers, so why are the states only focusing on the one rule that was designed to be temporary? Why don’t they just enforce the other laws? Better still, why don’t they demand that the Federal government hire more judges so they can process immigrants more quickly? According to government records, we are processing about 2,500 immigrants per day. Nearly a century ago, Ellis Island was processing an average of 5,000 a day, with a record day of 11,500. They were able to do that with pencils and paper, and we cannot match their speed even with computers.

There seems to be one thing that some do not understand about laws in this USA, once on US soil you are under the jurisdiction of the US Government, and according to that US law everyone charged with a crime is entitled to their day in court in this USA. There is another fact in evidence, you can not deport a person or persons to another country without their permission to let the person into their country, and actually is a violation of US law, to deny the person their day in a US court, and all the appeals which go with that day in a US court.

You meant to say they don’t have the same rights as US citizens, correct. Citizens have a right to a trial when charged with a crime…illegal trespassers can be immediately removed from the property and “sent home”.

Please enlighten me. If the POTUS is supposed to be sworn to uphold the constitution and the laws of the US then why are illegal immigrants being allowed into the country legally. If the POTUS is supposed to protect and defend US citizens then why are illegal immigrants offered more protections than US citizens. If it is clear that the majority of citizens feel the POTUS is sending the country in the wrong direction and if his own Democratic party feels this way,save the far left, then if he is elected by the people and for the people why is he able to ruin the country without consequence. Where is it written that citizens of th US have to watch the country be destroyed until the next election. Where is the failsafe to prevent this dictatorship? If it is so evident that this feeble, babbling, squinty eyed embarrassment to our nation and other nations is unfit to run the country then at the very least he should be given the clock test and be screened for dementia like most Americans have to be past the age of 65. If he fails wouldn’t he be unsafe to run the country or we just afraid of the alternative which might be worse.

Illegal immigration has been going on for years, and NOT ONE PRESIDENT, other than Trump had the cojones to address it! I have lived in aborder state for over 46 years, and the illegal sneak in, then “ demand their rights! What rights? As border jumpers they are criminals, breaking our laws, and nothingbis fine! The southern border should be closed period, with warning signs stating if they sneak in, they will be dealt with harshly, and immediately deported. The “ get seats” should be caught and sent back immediately! Sending bus loads to D.C. is just allowing Biden to send them all over our country! Send them back period!!! No amnesty, no citizenship unless they come in legally and no exceptions!
