Supreme Court grants temporary stay of Title 42 until February hearing [Video]

- The Supreme Court allowed Title 42 to remain in effect by granting another temporary stay on Tuesday.
- The pandemic-era policy shall continue until the high court justices hear arguments from Republican-led states in February 2023.
- Justice Neil Gorsuch acknowledged that “the current border crisis is not a COVID crisis,” but noted that the justices are not policymakers.
Title 42 remains in effect after the Supreme Court granted another temporary stay on its termination on Tuesday. The policy shall continue until the high court hears the Republican-led states’ arguments in February 2023.
Launched during former President Donald Trump’s administration, the pandemic-era policy allowed immigration authorities to quickly expel migrants over public health concerns.
Last month, U.S. District Judge Emmet Sullivan ruled in favor of immigration advocates who argued that the policy is no longer needed. Its termination was set to Dec. 21.
On Dec. 19, Chief Justice John Roberts granted a temporary stay on the policy’s termination.
On Tuesday, justices voted 5-4 in agreeing to hear arguments from Republican-led states during a hearing scheduled in February 2023.
Justices Samuel Alito, Amy Coney Barrett, Brett Kavanaugh, Roberts, and Clarence Thomas voted in favor, while Justices Neil Gorsuch, Ketanji Brown Jackson, Elena Kagan, and Sonia Sotomayor voted to deny the application.Â
The Supreme Court’s ruling blocks the district court’s order to terminate Title 42. However, it does not stop the federal government from acting with regard to the policy.
Gorsuch pointed out that even the federal government has admitted “that the end of the Title 42 orders will likely have disruptive consequences.” But he agreed that “the current border crisis is not a COVID crisis.”
Gorsuch added, “Courts should not be in the business of perpetuating administrative edicts designed for one emerÂgency only because elected officials have failed to address a different emergency. We are a court of law, not policymakÂers of last resort.”
Migrants have been denied entry by Title 42 for over 2.5 million times. But Customs and Border Protection still reported a record 2.3 million migrants at the border in the fiscal year 2022.
The White House acknowledged that President Joe Biden’s administration will “comply with the order and prepare for the Court’s review.”
Press Secretary Karine Jean-Pierre said that they are also “advancing our preparations to manage the border in a secure, orderly, and humane way when Title 42 eventually lifts and will continue expanding legal pathways for immigration.”

By now if people don’t understand that since hundreds of thousands of poverty stricken people with NO LEGAL MEANS TO SUPPORT THEMSELVES that have crossed the southern border is the exact reason the theft crimes and deaths by drug related crimes and the homeless crisis are all at all time highs they have to be deaf and blind…
