U.S. District Judge Allison D. Burroughs signaled her intention to grant Harvard a preliminary injunction. This move is aimed at stopping the Trump administration from barring the university from enrolling international students. However, Dershowitz provided a comprehensive legal explanation as to why he thinks Harvard’s challenge will ultimately fail.
According to Dershowitz, “The United States government has the absolute, unequivocal right to decide who comes into the country and who doesn’t.” He emphasized that this authority is not within the jurisdiction of the judiciary.
Dershowitz further clarified that this issue is not about academic freedom or constitutional speech rights but rather about the sovereign control of national borders.
“It’s a privilege to come into the United States, and the government has an absolute right to prevent people from coming in,” he stated. While there may be debates over whether the legislative or executive branch holds the ultimate authority, Dershowitz insists that judges have no say in these decisions.
The Trump administration had informed the court that Harvard would be given 30 days to present evidence challenging the government’s decision. Meanwhile, Homeland Security Secretary Kristi Noem accused Harvard of promoting antisemitism and collaborating with the Chinese Communist Party.
Despite a federal judge’s intervention to halt the administration’s move, the termination of Harvard’s federal grant remains in effect. Dershowitz’s insights suggest that Harvard’s legal position is precarious, with the constitutional power to control U.S. borders firmly in the hands of the federal government.

I am waiting for SCOTUS to rule, once and for all, about left-wing judges frivolously interfering with National Policy, which is NOT their business. Maybe this signals that courts need to be reviewed for those biased judges who will do anything to stop President Trump from doing his duty rather than following the law. It is sickening that the lawfare can continue because judges do not care about the law, and only in pushing their political agendas. They are like a swarm of bees harassing the president with no legal foundation at all. When judges actively violate the law, they should be removed and prosecuted. And Professor Dershowitz, who is a liberal (a REAL liberal, not a left-wing fanatic) knows whereof he speaks and writes.

I agree with you 1000%. We are witnessing the perfect reason to take a deep look into the SCOTUS. With dozens of these politically motivated frivolous cases against Trump one would think the SCOTUS would from a purely common sense prospective would have acted years ago. It is time to put monetary penalties on the activities of activist judges at every level when the court dismisses or overturns the activist ruling. One does not need to be an expert on the laws to know this is very wrong and bad lawyers and judges MUST BE PUNISHED.

Well, we cannot trust judges or the Supreme Court-so Trump is left to fight this stupidity himself, harvard university is doing illegal things and they got caught. Defund defund defund and don’t listen to our corrupt Supreme court.
