Justice Samuel Alito has defended the Supreme Court’s decision to overturn Roe v. Wade. He described the ruling as an act of judicial courage. Alito emphasized that the Court fulfilled its constitutional duty rather than yielding to political pressure.
Alito cautioned that attempts to intimidate the judiciary threaten the rule of law. He warned that such tactics endanger both the courts and broader public life.
“I think it’s a danger to the courts, and I think it’s a danger to others in public life”
The landmark decision ended the federal imposition of abortion policy. It returned authority to the states where elected representatives can reflect the will of their citizens.
Supporters argue that the ruling restores democratic accountability. They maintain that elected legislatures rather than unelected judges should decide contentious moral questions.
Critics continue to attack the Court and individual justices for the decision. Alito’s remarks underscore the importance of judicial independence in the face of such pressure.

Supreme Court Justice Samuel Alito said the 2022 Dobbs v. Jackson Women’s Health Organization case, which overturned Roe v. Wade, required “courage” from all of the justices in the majority. "We didn’t know it when we produced the draft that was leaked, but it required courage to go ahead with that because of the implications," he said. He told CBS News’ @JanCBS that he lost friends over the Dobbs decision. And he called physical threats and harassment "quite disturbing" and "a danger for the courts."
