The Supreme Court has agreed to expedite the case concerning President Trump’s authority to impose sweeping tariffs. The announcement comes after the U.S. Court of Appeals for the Federal Circuit decided Trump had exceeded his power under the IEEPA by imposing tariffs on imports from several countries.

Last week, the Trump administration promptly requested the Supreme Court to hear the case in November, stating that the Appeals Court ruling “gravely undermines the President’s ability to conduct real-world diplomacy and his ability to protect the national security and economy of the United States.”

The Supreme Court accepted and will begin hearing oral arguments in the first week of November.

Treasury Secretary Scott Bessent stated that halting the tariffs would require the U.S. to refund roughly $1 trillion to importers, calling it a move that “would cause significant disruption” to the economy.

U.S. Solicitor General D. John Sauer said, “With tariffs, we are a rich nation; without tariffs, we are a poor nation… The economic consequences would be ruinous.”

President Trump criticized the lower court’s ruling, saying, “it would be a total disaster for the Country” if his tariffs were revoked.

“If allowed to stand, this Decision would literally destroy the United States of America,” Trump declared.

The Appeals Court has delayed implementing its decision until October 14, allowing time for the Supreme Court review.

The IEEPA, enacted in 1977, lets the president impose tariffs after declaring a national emergency. Trump declared such a state over foreign trade practices, aiming to bolster American industry and protect workers.

If the Supreme Court strikes down the tariffs under the IEEPA, the administration may use other laws—like the Trade Expansion Act of 1962—to continue some of the measures. Certain tariffs that Trump enacted using this law would not be affected by the Supreme Court’s decision.
