This decision follows Ken Paxton’s admission of an extramarital affair during a 2018 meeting with his staff and wife. At that time, he assured that the relationship had ended and expressed his commitment to mending his marriage. The affair was brought into the spotlight again during his 2023 impeachment trial, with both sides agreeing that the woman involved was “unavailable to testify.”

The impeachment proceedings revealed details of the affair publicly for the first time. Former chief of staff Katherine “Missy” Cary testified about discovering the relationship and confronting Ken Paxton. Cary also warned him that the affair could leave him susceptible to potential bribery, a central allegation in the impeachment case, and could compromise his ability to serve effectively.
