In a striking move, Senate Minority Leader Mitch McConnell took to the Senate floor to express his disapproval of two federal judges who decided to reverse their retirement plans. This decision came after the re-election of former President Trump, prompting McConnell to label the actions as “open partisanship.”
The two judges in question, Algenon Marbley of Ohio and Max Cogburn of North Carolina, had previously announced plans to retire. However, both have now decided to remain active, a decision McConnell finds troubling.
“Looking to history, only two judges have ever unretired after a presidential election,” McConnell stated, highlighting the rarity of such actions.
He emphasized that this move by the judges is unprecedented in its timing and nature. McConnell pointed out that these decisions came after “the American people voted to fire Democrats last month,” suggesting a political motive behind the judges’ actions.
Judge Marbley, appointed by President Clinton, cited the lack of a confirmed successor as his reason for staying on. “I have therefore decided to remain on active status and carry out the full duties and obligations of the office,” Marbley explained.
Similarly, Judge Cogburn, appointed by President Obama, has also decided against retirement.
McConnell expressed concern over the potential implications of these decisions, urging the incoming Trump administration to “explore all available recusal options with these judges.”
He warned of the dangers of setting a precedent where judges reverse retirement decisions based on political outcomes, stating, “It’s literally unprecedented. And to create such a precedent would fly in the face of a rare bipartisan compromise on the disposition of these vacancies.”
The bipartisan agreement McConnell referred to involved a deal allowing Trump to appoint four appellate court judges, while Democrats agreed to confirm several of Biden’s district court nominees.
McConnell did not mince words, cautioning that “significant ethics complaints” could arise if more judges follow suit. He concluded with a stern warning: “As I repeatedly warned the judiciary in other matters, if you play political games, expect political prizes.”
This situation underscores the ongoing tensions in the judiciary and the political ramifications of judicial appointments and retirements.

More liberal hypocrisy. This is showing the very partisanship that the left has been screaming about and pointing fingers to the SCOTUS about. Another case of Two wrongs don’t make a right. If it’s wrong for one side to do it, it’s just as wrong for the other side.

Regardless of what anyone says here online; It is very clear that the ONLY purpose of a judge reversing retirement decisions after the election is related to political activism. Political activism is something that NO JUDGE should ever be allowed any involved,ent with under any circumstance. This includes every form, donations to stumping. Judges need to be above the fray and willing to sacrifice political voice when in office.
Time to find the way to unseat them MORONS who obviously have been politically active in bench decisions. Disrobe them and leave them in thier own disgrace

These judges expect to participate in more lawfare against patriots during the next four years.
