  • The Justice Department filed a lawsuit against Pennsylvania State University on Thursday, alleging its in-state tuition policy for undocumented migrant students violates federal law by discriminating against U.S. citizens.
  • Assistant Attorney General Brett A. Shumate stated that Congress prohibits states from granting tuition benefits to illegal aliens unless those same benefits are offered to all U.S. citizens.
  • The lawsuit is the 27th filed by the Department of Justice challenging in-state tuition policies that favor illegal migrants over American citizens.

The Justice Department is taking legal action against Pennsylvania State University, claiming its tuition policy gives illegal migrants an unfair advantage over American citizens.

The suit alleges that undocumented students who meet residency requirements are allowed to pay in-state tuition rates, while U.S. citizens living outside Pennsylvania are denied the same benefit.

“Congress made a deliberate policy choice that states and their public institutions may not grant tuition benefits to illegal aliens unless those same benefits are made to all U.S. citizens,” Assistant Attorney General Brett A. Shumate said in a statement.

“This university has ignored that mandate. The Department will continue to challenge policies that unlawfully disadvantage American citizens,” he continued.

The DOJ contends that the policy violates federal law by prioritizing the needs of illegal migrants over American citizens.

The complaint seeks to block Penn State from enforcing the current policy and from adopting any future tuition plans that favor illegal migrants over U.S. citizens.

“The Department of Justice today continues its efforts to ensure that no state law or university policy gives preferential treatment to illegal aliens over our Nation’s own citizens,” Associate Attorney General Stanley E. Woodward, Jr. said in a statement.

“Congress long ago made clear that states, through their public universities, cannot give reduced tuition to illegal aliens not available to all Americans.”

The case is part of a broader effort by the Trump administration to enforce federal immigration laws and protect the rights of American citizens in public institutions.
