Colbert Faces Scrutiny on Equal Time Claims

Clear Facts
- Rep. Jasmine Crockett stated she has not been invited back to Stephen Colbert’s show since the FCC controversy.
- The FCC equal-time rule requires broadcast networks to offer equal air time to political candidates, but does not cover cable or streaming platforms.
- Reports show late-night programs and talk shows overwhelmingly feature liberal guests over conservatives.
Rep. Jasmine Crockett, D-Texas, addressed recent controversy regarding Texas Rep. James Talarico’s interview on “The Late Show with Stephen Colbert.” She noted she has not been asked to return to the program following disputes about equal-time regulations.
The Federal Communications Commission established rules in 1934 mandating broadcast networks give equal air time to political candidates. However, these rules do not apply to cable networks, streaming services, or podcasts.
FCC Chairman Brendan Carr suggested that late-night and daytime talk shows be evaluated for possible equal-time violations. On February 16, Colbert discussed having invited Rep. Talarico for an interview but claimed legal advice prevented the broadcast from airing during campaign season.
“Donald Trump’s administration wants to silence anyone who says anything bad about Trump on TV, because all Trump does is watch TV, OK? He’s like a toddler with too much screen time. He gets cranky and then drops a load in his diaper.”
CBS later released a statement asserting the interview was not banned and legal guidance cited potential triggers for the equal-time rule for other candidates, including Rep. Jasmine Crockett. Colbert responded that the show’s script had been approved by CBS’s attorneys.
Some industry observers noted that late-night programs such as Colbert’s rarely feature conservative figures. Colbert, for example, has hosted 230 Democrat or liberal guests, while only once inviting a Republican—former Rep. Liz Cheney, following her primary defeat.
This disparity raises concerns about ideological balance in broadcast programming. While network representatives insist legal compliance, critics argue that these shows only amplify one side of the political spectrum.
