Clear Facts

  • TikTok is preparing for a potential shutdown in the U.S. due to the sell-or-ban law.
  • The law mandates ByteDance to divest its stake in TikTok or face a ban, which is set to take effect this Sunday.
  • TikTok users may receive a pop-up directing them to a website about the ban, with an option to download their data.

As the deadline looms, TikTok is bracing for a potential shutdown in the United States. This comes as the sell-or-ban law, which requires ByteDance, TikTok’s parent company based in Beijing, to divest its stake in the app, is set to be enforced.

The deadline for this divestment is this Sunday, and ByteDance has yet to comply, putting TikTok at risk of being banned in the U.S.

While the legislation aims to prevent new downloads of TikTok on platforms like Apple and Google, existing users might still have access for a limited time.

However, sources indicate that TikTok plans to implement a different approach. Users attempting to open the app could be greeted with a pop-up message, directing them to a website with detailed information about the impending ban.

Moreover, TikTok intends to offer users the ability to download all their data, ensuring they can retain their personal records.

A source familiar with the situation noted that the shutdown of TikTok’s U.S. services could be executed swiftly, as it doesn’t require extensive planning.

Interestingly, if the ban were to be lifted, restoring services could also be accomplished in a relatively short timeframe.

The only potential reprieve for TikTok would come from the U.S. Supreme Court, which TikTok has approached with an emergency appeal to block the legislation.

In a twist of irony, TikTok, which is tied to the Chinese Communist Party, argues that the law infringes upon Americans’ First Amendment rights.

The sell-or-ban law has garnered bipartisan support in the U.S., with lawmakers expressing concerns over TikTok’s ties to the Chinese government, fearing it could be used for espionage or propaganda.

Chinese officials have countered that forcing ByteDance to sell its stake would effectively mean exporting its technology to the U.S.

Meanwhile, TikTok has dismissed rumors of ByteDance considering a sale to Elon Musk, labeling such reports as “pure fiction.”
