WHAT YOU NEED TO KNOW:

  • Even though Trump is only on his first term, he was able to confirm 200-lifetime serving federal judge, a record high in decades.
  • Of all the top-ranking judges appointed by Trump, none was a Black- American, and is comprised mostly of young traditionalists.
  • A political expert said that Trump made a significant impact in terms of judiciary change as he is ahead in his predecessors in filling the court of appeals vacancies.

On Wednesday, Senate Republicans confirmed the 200th-lifetime federal judge President Donald Trump has appointed, the highest number made by any administration under the first term in decades.

None of the high ranking judges named by Trump across the nation’s judiciary was black. Also, the court of appeal positions nationwide has been filled thoroughly for the first time in decades.

Trump reached another landmark as Republicans agreed to confirm Cory Wilson at the 5th Circuit of the U.S. Circuit Court of Appeals.

The president will undoubtedly boast about the number because it shall be a part of his legacy. In summary, Trump has put two Supreme Court justices, confirmed 53 judges in the courts of appeals, 143 in the district court, and two on the U.S. Court of International Trade.

These judges are all Article III level posts, which means they will stay on the position for a lifetime but can only be fired through the impeachment process.

With the latest development, Trump has confirmed more judges than past presidents Barack Obama with 152, George W. Bush with 90, and Bill Clinton with 186. As compared with President Jimmy Carter, though, Trump fell short by only 39.

When it comes to the ratio of court vacancies Trump has filled in contrast to the total of judgeships that has, he’s only average as to other presidents, and the reason for being is the total number judgeships has revised in years.

Russel Wheeler, a visiting professor at the Brookings Institution’s Governance Studies Program, said that Trump’s effect on the jurisprudential development is quite significant.

Wheeler, who is also the president of a nonpartisan think tank, the Governance Institute, added that Trump is ahead from most previous presidents on the courts of appeals only.

Wilson is president Trump’s 53rd judge to confirm in the court of appeals. Obama, on the other hand,  assigned 55 judges in the appeals court for eight years.

Reports indicate that Trump’s appointment in appeals court has several things in common. They are overpoweringly young, traditional, and white Americans, which previously had citations for being aggressive toward voting, LGBTQ, and women’s reproductive rights.

Also, no one is Black-Americans in Trump’s 53 appeals court judges. Thirty-six of these are white men, eleven are female, seven are Asian Pacific American, and one is Latino.

Meanwhile, judges previously appointed by Democrats who are planning to retire may have to stay on their post until November and wait if Joe Biden wins.

If Biden does win, Wheeler added, “The flood gates may open and [Democrats] would get a lot more vacancies.”
