Trump Faces Tariff Ruling Setback High Court Next

President Trump’s major tariffs were struck down by a federal appeals court, but his administration is aggressively pursuing other means to defend and sustain the policy.
The Supreme Court is now the next stop for the administration, which remains optimistic that it will rule in favor of the president’s interpretation of emergency trade powers.
Trump declared a national emergency in April, invoking IEEPA due to unfair trade practices allegedly harming American security and the economy.
These tariffs have generated significant government revenue and are projected to dramatically reduce the deficit.
Despite the legal setback, the court has permitted existing tariffs to remain in force until mid-October while the administration seeks a Supreme Court review.
Trump called the appeals court “highly partisan” and announced plans to appeal quickly to the Supreme Court for an expedited decision.
“I’m confident the Supreme Court will uphold it — will uphold the president’s authority to use IEEPA,” Treasury Secretary Scott Bessent said.
Legal backup options exist, such as Section 338 of the Trade Act of 1930, Section 301 and Section 122 of the Trade Act of 1974, and Section 201, each providing a different scope and duration of tariff authority.
Current tariffs on steel, aluminum, and copper under Section 232 of the Trade Expansion Act remain unchallenged and consistent with prior policies.
Bessent acknowledged that these other tariff options are “not as efficient, not as powerful.”
Congress may also be urged to implement a general tariff: bipartisan legislation introduced in August would impose a 10% baseline on all imported goods and create specific penalties for Chinese imports.
“We remain confident in ultimately prevailing with our tariffs as structured,” a White House official stated.
Trade analyst Kenneth Rapoza warned that if the Supreme Court rules against the administration, it could lead to refunds for companies and large gaps in budget and tax cut projections.
“If the Supreme Court does not rule in their favor and they’re thrown a big curveball, it would be a big problem for the Trump administration and for the economy,” Rapoza observed.
Rapoza added, “That revenue projection has been destroyed, and that’s going to be probably more chaotic than what the original Liberation Day announcement was.”
Trump warned that invalidating his tariffs could jeopardize massive upcoming investments in the United States from international trade partners.
“More than 15 Trillion Dollars will be invested in the USA, a RECORD. Much of this investment is because of Tariffs. If a Radical Left Court is allowed to terminate these Tariffs, almost all of this investment, and much more, will be immediately cancelled! In many ways, we would become a Third World Nation, with no hope of GREATNESS again,” Trump said.
The administration is determined to keep pressure on unfair trade at a time when billions in investments depend on maintaining a strong American position.
