Trump rape accuser to sue for sexual battery under new ‘survivors’ law

Writer E. Jean Carroll is planning to sue former President Donald Trump for sexual assault under a new law that allows victims to sue over attacks that happened decades ago.

Carroll’s lawyer, Roberta Kaplan, wrote to a federal judge in August to notify of her client’s intent to sue for sexual battery and intentional infliction of emotional distress.

That letter was entered into the public record on Tuesday.

Carroll already has a pending defamation case against the former president. Kaplan aims to depose Trump by Oct. 19, when the discovery of the case must be completed for a planned February trial.

Trump’s attorney, Alina Habba, objected to the new lawsuit in an Aug. 11 letter to the court that was also published on Tuesday.

Habba cited the looming trial deadlines in the defamation case, arguing that a new claim “would be extraordinarily prejudicial” to Trump.

Habba wrote, “To permit Plaintiff to drastically alter the scope and subject matter of this case at such time would severely prejudice Defendant’s rights. Therefore, Plaintiff’s request must be disregarded in its entirety.”

Carroll is a longtime advice columnist for Elle magazine. She claimed in a 2019 book that Trump raped her in the mid-1990s during a chance encounter at a Bergdorf Goodman store.

Carroll would not have been able to sue over the alleged attack since it happened decades ago, way beyond legal deadlines. But after Trump denied the allegations and cast doubt on her credibility, Carroll sued him for defamation instead, claiming that the former president smeared her reputation.

Last spring, the Adult Survivor’s Act was passed in New York, giving adult survivors of sexual attacks one year to bring civil claims that would have otherwise missed legal deadlines.

The law was modeled after the Child Victims Act, which allowed a similar window to bring lawsuits for people who had been sexually assaulted when they were children. The law expired about a year ago.

In February, Carroll’s legal team was willing to skip a deposition to fast track the lawsuit into a trial. But Kaplan now called for a deposition, arguing that Trump’s legal team turned over so few documents relevant to the case.

A deposition would mean that Trump has to answer questions about Carroll’s accusations under oath.

Habba’s court letter argued that Kaplan’s letter was “filled with misrepresentations and inflammatory statements.”

    1990’s ? There should be time limits. This is ridiculous that people can’t get attention any other way. I’m sorry but this ties up our courts and time needlessly and for something 20:or more years old, can’t be proved. Geez get over yourselves, please. This is another political stunt of democrats again. No US court should even look at this ongoing garbage.

      I agree it is to easy to lie about twenty years later, if it was so why wasn’t there any thing about it until now? Isn’t there a law about slander anymore? Shame on the person that thinks she can make up a story to try and ruin someones life. GOD knows the truth and one day you’ll have to answer for it. GOD save your soul.

    I call bullllshiiit. I am so sick of women accusing men 20. 30 years after the fact. Which of course, no evidence left. IMO. this is just another blackmail scheme using the legal system to get rich. And, in the process defame Trump…which I believe is the real goal.

    The skank is a stooge for the Democrats period. What took the skank so long to file this fake charge? Trump now knows when you call the scum out for what they are they mount a massive attack and IF Trump does run for POTUS in 24 he will have the same treatment only worse.
