Leftist Judge Creates Constitutional Crisis—SCOTUS to Step In Soon

Clear Facts
- A federal judge’s ruling has sparked a constitutional crisis by challenging the president’s authority over executive branch appointments.
- The Supreme Court is expected to intervene and overturn the ruling that reinstated Hampton Dellinger as Special Counsel.
- Judge Amy Berman Jackson’s decision contradicts established precedents regarding the president’s removal power over executive officials.
In a move that has set off alarm bells across the nation, a federal judge has issued a ruling that could lead to a constitutional crisis, one that only the Supreme Court can resolve. Judge Amy Berman Jackson, appointed by former President Barack Obama, declared that Hampton Dellinger is to remain the Special Counsel of the Office of Special Counsel for the duration of his five-year term, unless removed under specific statutory conditions.
This decision, made late on a Saturday, mandates that several executive branch officials recognize Dellinger’s authority and refrain from obstructing his duties. This ruling has raised significant concerns about the balance of power within the federal government.
The scenario becomes more complex when considering the potential actions of President Donald Trump, who might attempt to override this ruling by directing other officials to terminate Dellinger’s access to federal resources. However, as Judge Berman Jackson acknowledged, federal courts do not have the power to directly enjoin the President of the United States. Her ruling thus targets five specific defendants, limiting its immediate impact.
Despite this, the Supreme Court is anticipated to step in and overturn the judge’s order. The potential for a revolving door of new defendants being ordered to ignore presidential staffing decisions highlights the precariousness of the situation. This case underscores the tension between judicial rulings and executive authority, a conflict that threatens the foundational principles of the republic.
Article II of the Constitution grants the president the executive power, including the authority to appoint and remove officials. Judge Berman Jackson’s decision challenges this by asserting that Dellinger cannot be removed except for cause, as specified by Congress. However, this stance seems to conflict with previous Supreme Court rulings, such as Seila Law v. CFPB and Collins v. Yellen, which affirmed the president’s right to remove agency heads at will.
In her opinion, Judge Berman Jackson attempted to differentiate the Office of Special Counsel from other agencies previously addressed by the Supreme Court. Yet, her ruling stands in contrast to the established doctrine that the president holds unqualified removal authority over executive officials. The Supreme Court’s intervention is crucial to resolving this constitutional impasse.
The Trump Administration has already sought relief from the Supreme Court, arguing that Judge Berman Jackson’s order violates the Constitution and defies court precedents. However, the Supreme Court has yet to take decisive action, leaving the situation in a state of uncertainty.
Justice Gorsuch, joined by Justice Alito, highlighted the gravity of the situation, stating, “The court effectively commanded the President and other Executive Branch officials to recognize and work with someone whom the President sought to remove from office.” This dissent underscores the unprecedented nature of the judge’s ruling and its potential implications for executive authority.
As the Supreme Court prepares to address these constitutional issues, the nation watches closely. The outcome will not only determine the fate of Hampton Dellinger’s appointment but also set a precedent for the limits of judicial intervention in executive branch affairs. The justices have a critical opportunity to reaffirm the constitutional balance of power and prevent an unnecessary crisis from escalating further.

The judge is not the one creating the “Constitutional Crisis”, Trump is.
There are specific steps in the Constitution for removing federal judges, and Trump has not followed a single one. He simply lets his hatchet man Elon get rid of anyone who isn’t on “their side” and for no other reason. A removal must be for “just cause” not just because.
A Constitutional Crisis happens when the executive branch feels it doesn’t need to obey the rulings of the judicial branch. Trump is not a king and we are still ruled by The Constitution.
This article is phony outrage disguised as “journalism” . Probably originates in Russia, designed to inflame the uneducated dopes who eat this garbage for breakfast, lunch, and dinner.

The President is discharging a government lawyer, not a judge, so your concern is unwarranted.

Bull crap you and the other leftist are living in la la land. All the dirt that the lefties have done and continue doing after losing all they lost in the election. The people have spoken and President Trump has the constitution and the people on his side. The left is in denial of the reality that they are on the minority side. They steal elections and are loud but the reality is they are the minority. They accuse everyone of everything they their are doing and guilty of. The hypocrisy of the left is really astounding and rich.

… oh, you mean like Biden did before him? Fine, let this lawyer stay until the SC ruling, just don’t give him any cases. He certainly would not be unbiased. BTW, you’re not being led by the Constitution either, you’re being led by Obama (under the the guide of Biden). This is exactly what they did. Trump needs people loyal to the admin., just as previous presidents have done before him. I bet you didn’t complain then. It’s your leftists’ fake news journalism that spreads the outright lies. That’s why their ratings are so low. Even some of the WOKE have awakened because they’re fed up with the fake news.

This article is a direct lie. The court precedents say that the President cannot fire this official. Trump wants to change this but the judge is simply following the law.

Judge Berman Jackson is dead wrong. Government employment IS NOT A JUDICIAL ISSUE. This is just more “lawfare” and must be abolished.

This article is indeed a propaganda piece disguised as objective journalism. Federal district court judge Berman is well regarded as fair by conservative and progressive lawyers alike. And notice that the only two Supreme Court justices quoted in the article (Gorsuch and Alito) were writing IN DISSENT. That means the rest of the Supreme Court, including Trump’s appointees, disagreed with them.
The real Constitutional crise is Trump’s refusal to obey the courts. Yes, the Supreme Court will have to step in.

I think it is about time that some of these left wing judges were made to obey the law, not the left wing party line. If judges deliberately try to overrule Supreme Court, they should face consequences.
