Clear Facts

  • Rep. Tony Gonzales introduced the Homeland Threat Response Act to expand protections for Border Patrol personnel assisting with investigations outside immigration enforcement.
  • BORTAC and BORSTAR, elite Border Patrol units, are frequently called to support state and local law enforcement at significant events and in emergencies.
  • The bill comes as U.S. cities prepare to host high-profile events like the Super Bowl, FIFA World Cup, and 2028 Summer Olympics.

Rep. Tony Gonzales, R-Texas, has urged Congress to boost legal protections for Border Patrol agents aiding state and local officers.

His Homeland Threat Response Act would amend federal law to cover Border Patrol during cases such as violent attacks and major public events, recognizing the increased duties outside their regular jurisdiction.

Gonzales referenced BORTAC and BORSTAR units, emphasizing their frequent work with local authorities beyond immigration matters.

“They’re doing so at a risk,” Gonzales stated.

He pointed out that these agents lack the same protections other law enforcement officers receive while operating outside their usual scope of work.

“They’re called upon and asked to operate in other spaces that aren’t their necessarily primary duty.”

Gonzales affirmed the legislation would “create a level playing field when it comes to protection.”

With the country hosting major sports gatherings like Super Bowl LX, the FIFA World Cup, and the Olympics, Gonzales said federal officers will be essential to security.

“It’s going to be this group that’s going to keep us safe,” Gonzales commented.

Border Patrol’s Special Operations Group has responded to mass shootings, criminal captures, and emergencies, demonstrating high-level training and expertise.

Gonzales highlighted ongoing discussions among Democrats regarding defunding the Homeland Security Department, especially following past immigration enforcement actions.

“I’m seeing Democrats cave to the liberal left that want to defund and want to make it harder for law enforcement to do its job,” he remarked.

He called for federal officers to focus entirely on their mission, without distractions or doubts about their legal protection.

“Let’s make sure that a federal officer in this space isn’t thinking about ‘what if…’ they are focused solely on their mission and completing the mission like they’re trained to do.”
