Appeals Court Blocks Probe Into Deportation Officials

Judicial overreach faced a significant setback when an appeals court stopped a district judge’s probe into national security deliberations. The court said the attempt to investigate officials over the deportation of gang members went beyond legal boundaries.

D.C. Circuit Judge Neomi Rao, writing for the majority, said the prior order gave no basis for criminal contempt. The ruling shielded executive branch deliberations from further judicial interference in a national security matter.

“The district court proposes to probe high-level Executive Branch deliberations about matters of national security and diplomacy,” Rao wrote.

“These proceedings are a clear abuse of discretion, as the district court’s order said nothing about transferring custody of the plaintiffs and therefore lacks the clarity to support criminal contempt based on the transfer of custody,” Rao continued.

“Moreover, the government has already provided the name of the responsible official, so further judicial investigation is unnecessary and therefore improper.”

The initial order blocking the deportations had already been vacated by the Supreme Court because of improper venue. The lower court nonetheless continued pursuing contempt charges before the appeals court intervened.
