California’s Controversial Public Gun Ban Takes Effect

Despite ongoing legal challenges, California’s new law banning firearms in most public places took effect on Monday. Last month, U.S. District Judge Cormac Carney, a George W. Bush appointee, blocked the law from taking effect in a Dec. 20 decision. He found the law to be “sweeping, repugnant to the Second Amendment, and openly defiant of the Supreme Court.”

However, the Ninth Circuit Court of Appeals temporarily paused Carney’s injunction on Saturday. This pause allowed the law to take effect beginning in 2024. “This ruling will allow California’s common-sense gun laws to remain in place while we appeal the district court’s dangerous ruling,” Democratic California Gov. Gavin Newsom said in a statement following the Saturday ruling.

The law, known as Senate Bill 2, prohibits concealed carry permit holders from bringing firearms into “sensitive places.” These places include playgrounds, churches, hospitals, and financial institutions.

The California Rifle and Pistol Association responded to the law on Monday. In a statement, they said that the restrictions are “justified by word games intended to end run the Constitution and Bruen.”

Judge Carney had strong words in his Dec. 20 ruling. “For many years, the right to bear arms, and so necessarily the right to self-defense, was relegated to second-class status,” he wrote. He added, “But the United States Supreme Court made clear in its landmark decisions District of Columbia v. Heller, McDonald v. City of Chicago, and New York State Rifle & Pistol Association, Incorporated v. Bruen that relegation could no longer be permitted—individuals must be able to effectuate their right to self-defense by, if they so choose, responsibly bearing arms.”

Gov. Newsom had a different view when he signed the bill into law on Sept. 26. He called the Supreme Court’s Bruen decision a “perversion.”

The Ninth Circuit Court of Appeals, however, paused Carney’s injunction, enabling this overreaching law to take effect. This law prohibits law-abiding citizens, who have undergone the rigorous process to obtain a concealed carry permit, from exercising their constitutional right in public places.

The California Rifle and Pistol Association rightly criticized the new law, stating that the restrictions are “justified by word games intended to end run the Constitution and Bruen.”

The right to bear arms is not a second-class right. As Judge Carney pointed out, the Supreme Court has repeatedly affirmed this right. California’s new law is not just an attack on the Second Amendment, but a clear defiance of the Supreme Court’s rulings.

    seem’s to work really well for the dumbarses considering all the shootings that take place in Cali with all their anti gun laws now dont it?

      Going sit back and watch those body drop! Hopefully most are democrats supporters and politicians! Violation our 2nd amendment rights to have firearms. But refused to stop crime with firearms!!! NEWSOM is a fools as is the nineth district Court! NOBODY SECURITY FOR GOVERNOR OR JUDGES! If the people can’t protect themselves then the politicians shouldn’t either!

    Where and when did the state of California acquire the right to ignore the U.S. Constitution ? A document that a huge number of US citizens served in the military supposedly defending; among other things; many of whom live in California. Do you folks in “government” there really think that all of the bad guys are going to now no longer carry their knives and chains and hammers, etc. and their guns? Defunding the the Police not long ago a good idea? You folks are in the wrong line of work.

    I’ve yet to see or hear of any Gun Law/Control that worked!!! All these laws have done is make it Open Season on the law-abiding citizen

    Any public place where there are a lot of people that prohibits the legal carry of firearms is known as a soft target. In other words, a place where a potential mass shooter knows there will be nobody there to shoot back until the police show up. Most police forces in these areas are underfunded, short staffed, and over worked. As much as they want to, they may not be able to respond in a timely manner.

    Lots of excited folks over gun laws. Do they want an America of unconcealed carry. Weapons for all on playground……… Are others as responsible as they? That is the sole option. Any laws meant to protect is to hedge against injustice. Gun laws only regulate activities of the law abiding. The offender must be discovered, tried, convicted, sentenced, and punished by those laws. I do suggest most who support laxed gun law, may change their minds when they or loved ones fall victim. Crimes committed with firearms should carry heavy sentences such that offenders are removed for a long time.

      The places in this country where open carry is common usually have the lowest rates of gun crimes. Criminals want easy targets and are unlikely to attempt armed robbery where many of the potential victims are likely to be armed.

    Newsom making his own laws again. Those who voted for him must be happy. So the crooks carry the guns and law abiding citizens are defenseless. Hope nothing bad happens or it will be on Newsoms shoulders

      5000 + gun laws presently exist in the U.S.A. This is typical knee-jerk liberal reactionary rhetoric utilized by the Left to help boost ratings and garner ballots st election times. The law accomplishes nothing! zero, zip. If the Dems and their ilk really want to do something useful, get rid of the liberal judges and replace them with conservative judiciary individuals that will enforce current laws already in force. No more catch and release!
      The master plan is to disarm good citizens, create chaos, then present a solution to the problems they themselves created. I suggest all freedom loving Americans find a copy of “Rules for radicals” by Saul Allinsky, who was an ardent Socialist who despised Capitalism and the American way. A mentor of the Clintons, and friend of Soros.A unarmed peasant won’t be able to defend themselves against the ruling elites.
