Bragg’s Bold Move to Uphold Trump’s Conviction
Clear Facts
- Manhattan District Attorney Alvin Bragg’s office has filed a legal brief urging Justice Juan Merchan not to dismiss Donald Trump’s guilty verdict in a Manhattan criminal case.
- Trump was convicted of 34 counts of falsifying business records related to a payment made to Stormy Daniels before the 2016 election.
- Bragg’s office argues that while Trump cannot be sentenced as president, the case can be deferred until after his potential second term.
In a bold legal maneuver, Manhattan District Attorney Alvin Bragg is pushing to ensure that Donald Trump’s conviction remains intact, even as the former president prepares to assume office once more. Bragg’s office recently filed a legal brief urging Justice Juan Merchan not to discard the guilty verdict against Trump, despite the complexities introduced by his upcoming presidency.
The case in question involves Trump’s conviction on 34 counts of falsifying business records. The charges stem from allegations that Trump attempted to conceal a $130,000 payment to Stormy Daniels, a former adult film star, ahead of the 2016 election. This payment was allegedly made to silence her claims of an affair with Trump, which he has consistently denied.
Trump’s legal team has been actively seeking to overturn the verdict, citing a Supreme Court ruling that grants former presidents substantial immunity from prosecution for official acts. However, this immunity does not extend to unofficial acts, leaving room for the case to persist.
Bragg’s office acknowledges that Trump cannot be sentenced while serving as president. Nonetheless, they propose that the case be put on hold until 2029, allowing for sentencing after Trump’s second administration.
“No principle of immunity precludes further proceedings before defendant’s inauguration,” the filing states. It further argues that deferring sentencing until after Trump’s term “respects the public interest in upholding the rule of law.”
The DA’s office emphasizes that dismissing the indictment is unnecessary, as there are alternative accommodations that address presidential immunity concerns. They argue that a stay in proceedings would exempt Trump from immediate obligations while maintaining the integrity of the criminal process.
Trump spokesman Steven Cheung has criticized the filing, calling it “a pathetic attempt to salvage the remains of an unconstitutional and politically motivated hoax.” He insists that the case should be dismissed to allow Trump to focus on his presidential duties.
In an interesting twist, Bragg’s office suggests using a legal procedure known as abatement, which preserves the conviction but halts further court proceedings. This approach is typically used when a defendant dies before sentencing, but Bragg sees it as a viable option to keep the conviction alive.
As the legal battle continues, Trump officials remain optimistic, stating that the case is “effectively over” following Bragg’s request for a stay. “Prosecutors are trying to save face,” a Trump official remarked, confident that the case will ultimately be dismissed.

In May 2024, he became the first former president to be convicted of felony crimes after a New York jury found him guilty on 34 counts of falsifying business records to conceal a $130,000 hush-money payment to an adult-film star to influence the outcome of the 2016 election.

I watched parts of the trial and the judge did not even allow the defense to argue back. It was a one way exchange, totally directed by the bidens.

Let’s just add this to the list of crimes our new president to be has gotten away with, right? We have been told over and over again no one is above the law, but that doesn’t seem to apply to one Donald Trump. If word came out about the Stormy Daniel’s thing he might not have been elected and the national nightmare of this selfish, corrupt, greedy liar might not have happened. Wait until you see the damage he will do to the country this time. You were warned.

You have an absurd view on life and the law. This is not a felony and the law is being abused. I assume that you are also a communist lover and wish to be comp[licit in assisting traitors to America?

Right on Alvin, the only attorney so far to not let sleazeball criminal Trump off the hook. Bragg has the courage to make Trump pay for the crime he DID commit.

Alvin Bragg and Justice Merchan are both complicit to attempting to overthrow the results of the last election There has been no sentencing or true conviction so no pardons are available. They want Pres. elect Trump to be diverted from his role as President. That is treasonous . Governors setting aside millions to subvert repatriation is also verging on treason. This pair of rascals should be criminally charged with subversion and obstruction of the law (no vigilante stuff), and material harm to the USA. The full option of the law should be on the table up to and including the death penalty. Until there are proper consequences for the heinous crimes then people will continue to do them. Elected communists will continue to enact egregious behaviour and America will be overrun.

It Was Michael Cohen — Not Trump that had the “Affair” with Stormy Daniels & He Was Also Convicted of Perjury & Other Counts , Also If Donald Trump Had Falsified
Business Records The IRS Would have Found Such When He Was Audited By them Going Back Well Before He ran for Public Office , Besides That was in 2006 & the Statute of Limitations Had Run-Out (2years for a Misdemeanor & 5 Years for a Felony as New Youk Law States) And any Person who knows about Law Would Know that No Warrant Shall Be Issued But On Probable Cause — Not Any NOVEL THEORY !!

The truth is even more absurd. What actually happened was that Daniels used and attorney to blackmail Trump legally (its only blackmail if she demands money, not her attorney (this law needs to change); Meanwhile, there is no place on any state or federal campaign expense form where the purchase of book rights can be legally listed as a campaign expense. Therein lies the rub. Including such on a campaign expense form would be a felony. The State of NY has unlawfully declared not listing it as a felony.
Meanwhile the judge refused to allow testimony from a campaign finance expert.
The judge, the prosecutor and everyone else involved in any way in the attempt to prosecute need to be arrested under 18 USC 241. This would require 15 years in federal prison for thier actions.
